Apparently yes, but I honestly think that charges on the level of wreckless manslaughter and trespassing are imminent.

Considering the violence of the collision, and the lack of telescoping, I'd say the newer design performed quite well.

There isn't much of a way to protect against a derailment when you over-run a trailer ... it's happened multiple times to both passenger and freight equipment.

They get up under the frame, and then it's pretty much all over.

Metrolink is having some second thoughts about the Rotem Cab Cars,due to this accident and it's plow pilot design,
from a story on KNX radio stream,Metrolink to lease BNSF power to use as Leaders instead of the cab car leading,
one offical was quoted"You can't put a price on Safety",unknown what power BNSF is supplying,but there will
be BNSF power on point in the near future...
