I have seen the term privately owned cars in reference to privately owned passenger cars owned by fan associations or individuals (usually w/ $$$). Does privately owned rail car in the sense of this article and freight mean rail cars not owned by the railroad or a leasing company?

It means all railcars not owned by a railroad company.

Mr. Not You, clearly the Railway Age article is addressing privately owned freight cars which have been exempt from public disclosure of drmurrage (detention) and an array of charges the industry refers to as accessorial.

These are the cars that have reporting marks ending with "X", and, honestly, are the most prevalent cars I observe.

I think the issue has much to do in that even post-Staggers, railroads are still required to publish their rates and offer them without discrimination. The accessorial charges appertaining "X" cars are not published and never have been. Within those charges, as distinct from the rate for a line haul, leaves much room for discrimination.
