I post this here because CSX is the primary plaintiff (and the USDOT and Homeland Security are also plaintiffs).
The problem here is stated to be one of who has interstate commerce control, and balancing it against terrorism. Baltimore probably has more ammo now, especially with the 2001 hazmat spill near downtown Baltimore's Camden Yards.
