Probably a bit of true on both sides of the argument. They would have to ensure there is no way a bidder could prove they were discriminated against. ( i.e you didn't take our bid because we a Chinese, even though we were the cheapest , for e.g) . Same as a employer can't discriminate against any potential employee. Proving it is another matter.
Usually Ttenders and bidding processes have a clear points system , with points been awarded for different aspects of a tender. Price been a major one , but not the only one.
Note: on a reread, I see I've pretty much said the same thing as Eolesen, perhaps more in Laymans terms.
